Canvas and Dreams Terms and Conditions

Canvas and Dreams requires all persons hiring equipment provided by Canvas and Dreams to have read and understood the contents of this document. Receipt of payment for hiring equipment assumes that you have read and agreed to these terms. If you do not understand any information contained within this document, or require further clarification on any of the points below, please speak to your contact at Canvas and Dreams.

For the purposes of these terms and conditions:-

  1. The registered office of Canvas and Dreams is 28 Branksome Hill Road, Bournemouth, BH4 9LD.
  2. The hirer is the company, firm or persons specified above, including their successors or personal representatives.
  3. Equipment includes all gazebos, hot tubs, projectors, projector stands, screens, lighting, decor, accessories and other hire equipment booked for the hire period.
  4. Goods means any equipment that we supply to you, the customer.
  5. Order means the customer’s order for the services from Canvas and Dreams.
  6. If the customer requests any specific requirements, it is the customer’s responsibility to ensure that any information or specification provided is accurate.
  7. All services are subject to availability.
  8. We reserve the right to make changes to the services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
  9. We reserve the right to amend our terms and conditions at any time without prior notice.

 

Canvas and Dreams reserves the right to refuse hire at any point if the following terms and conditions have not been adhered to.

Suitability and Delivery

  1. The equipment shall be deemed to be in good order and in accordance with the customer’s satisfaction, unless notification is received by Canvas and Dreams on the day of delivery.
  2. No warranty is given that the equipment is suitable for the purposes of the customer.

 

Customer Responsibilities

  1. The customer must provide us with access to any premises under their control as required, and provide us with all information required to perform the services.
  2. If the customer fails to comply with any of the above, Canvas and Dreams will suspend the service until it is remedied by the customer, or if the customer fails to remedy it following our request, Canvas and Dreams can terminate the contract with immediate effect on written notice to the customer.

 

Accidents or Injury

  1. The customer acknowledges that the use of hot tub, cinema, electrical, audio visual and all other outdoor equipment and any other equipment hired from Canvas and Dreams is at the customer’s own risk.
  2. Canvas and Dreams will not be liable for accidents, injuries, or death caused by the misuse of our hot tub, cinema, electrical, audio visual and all other outdoor equipment  and any other equipment.
  3. If the customer has any health concerns or is on medication, they must consult their doctor before using a hot tub or utilising equipment hired from Canvas and Dreams.

Damages to your Property

  1. Canvas and Dreams will not be held responsible for any loss or damages to property through hiring any of our equipment, regardless of culpability.  This includes any water damage or weight damage to structures, fixtures, fittings, garden or grass areas as a result of the hot tub, cinema or gazebo location.
  2. It is the customer’s full responsibility to make sure the area where the hot tub, cinema or gazebo is going to be placed is suitable and will not cause any damage.

Risk

  1. Risk of damage to, or loss of, any goods will pass to the customer when the goods are delivered to the customer.
  2. Canvas and Dreams will not be liable for any delays in the supply of equipment materials and services by it or for any losses whatsoever due to any such delays howsoever caused.
  3. While Canvas and Dreams shall make every effort to assist the customer with technical know-how and experience and shall provide general advice and service Canvas and Dreams shall not guarantee that the customer will achieve his intended result by the use of hired equipment and services.

Delivery and Collection Policy

  1. Canvas and Dreams will deliver, set-up and collect equipment.
  2. Delivery and collection slots will be confirmed to the customer within 24-48 hours before the delivery date, once driving routes have been confirmed. Please ensure that you are available on the day of delivery and collection, during normal working hours.
  3. Upon delivery and set up, Canvas and Dreams will be there to guide the customer through any equipment and controls, and advise on anything else needed for the rental.
  4. Please ensure that there is nearby power supply within 20 metres, and a nearby water supply (hose or tap) within 25 metres for any hot tub hires.
  5. If Canvas and Dreams are unable to provide the delivery due to adverse weather, vehicle failure, illness or any other unfortunate situation, then Canvas and Dreams will inform the customer of this at the earliest possible opportunity. Should this occur, the customer is entitled to either a full refund or booking for an alternative date.
  6. It is the customer’s responsibility to ensure that there is adequate space for our products, and that the desired location is accessible and clear of any mess or debris. Canvas and Dreams will be unable to provide a refund if we cannot deliver the product due to a lack of space or accessibility or due to an inappropriate location.
  7. On collection, Canvas and Dreams will need access to the area and electricity source.
  8. Any Equipment which is not available at collection, must be returned to Canvas and Dreams and a hire charge will be applied for the extra time period.
  9. Please note the hot tub must be emptied prior to collection on the last day.

HOT TUB HIRE

DISCLAIMER – Do’s and Don’ts

  • DO lift the lid as per the instructions given.
  • DO replace the lid after use. This is what keeps the water hot when not in use.
  • DO use the shower before entering the hot tub.
  • DO brush any mud/grit from your feet before entering the water.
  • DO exercise caution to prevent unauthorised access to your hot tub. Ensure your hot tub cover is securely fastened when spa is not in use. There is NO GUARANTEE that the cover, actual lock or clip tie downs will prevent access to your hot tub.
  • DO consult your physician before using your hot tub, especially if you suffer from heart disease, diabetes, high or low blood pressure, a condition needing medical treatment, pregnant women, infants or the elderly. We will not be held responsible for any chemical or allergic reactions. If this is a likely result of using our hot tubs, please consult your doctor before use.
  • DO take care of all accessories hired with the hot tub to ensure they do not get damaged and ensure all items are returned in the same condition as delivered.
  • DO NOT wear lotions, oils, makeup, fake tan or skin creams in the hot tub. Fake tan or hair dye will cause stains, therefore if the hot tub is heavily stained upon collection, a cleaning bill may be invoiced to the customer for up to £50.00.
  • DO NOT exceed the maximum number permitted in the hot tub.
  • DO NOT allow children under 5 to use the hot tub.
  • DO NOT leave children unsupervised.
  • DO NOT use oils, soap or any detergent in the water other than the ones provided by Canvas and Dreams.
  • DO NOT eat in the hot tub.
  • DO NOT use glassware in the hot tub.
  • DO NOT smoke in the hot tub.
  • DO NOT jump into the water or play ball games.
  • DO NOT sit, stand or lie on the lid of the hot tub at any time; or allow children on the lid.
  • DO NOT sit on the sides of the hot tub.
  • DO NOT wear any jewellery in the hot tub as it may puncture the tub.
  • DO NOT use the hot tub after a heavy meal or while under the influence of excessive alcohol or sedatives.
  • DO NOT allow dogs or other animals inside the hot tub.
  • DO NOT allow naked flames inside or within one metre of the hot tub.
  • DO NOT use the hot tub in a storm, thunder or electrical.

Water Maintenance and Chemical Treatment for Hot Tubs

  1. A care kit will be provided to the customer for the duration of the hire; containing clear instructions, contact information and all necessary chemicals and equipment to maintain sanitisation of the water. Once setup is complete any maintenance is the customer’s responsibility.
  2. Canvas and Dreams will not be held liable for general water maintenance during the hire period. Please do check the chlorine and PH levels daily using the test strips provided and add the provided chemicals accordingly. Allow at least 1 hour after dosage before using the hot tub.
  3. Please be careful to not allow chlorine to come into contact with skin. Do not ingest or inhale it. Chlorine should be stored in a cool dark place, away from children.
  4. Canvas and Dreams thoroughly clean and sanitise all hot tubs between each hire.

Water Filling and Heating Times

  1. Filling the hot tub with water takes around 1-3 hours using a standard garden hose, this may take longer depending on water pressure. Once the hot tub is filled with water, it takes around 12 -24 hours to heat the water to optimum temperature.
  2. Please keep the insulated lid on when the hot tub is not in use, to help preserve the heat and for the safety of animals and young children.

 

Maintenance, Care and Alterations

  1. The customer shall be responsible for maintaining the equipment in the same condition and working order as on the date of delivery and for ensuring the equipment is in good and clean condition on the completion of the hire period. Any loss, damage or additional cleaning costs are chargeable to the customer.
  2. If the customer has issues with the hot tub, despite having followed instructions, then please contact Canvas and Dreams immediately for telephone support.
  3. In the event of severe weather conditions including wind, frost, snow, hail, heavy rain and storms, the customer will take action to minimise damage to the equipment including ensuring that all equipment is secured.

Connection to Mains Services / Electrical Equipment

  1. Connection and disconnection to mains services on site are the responsibility of the customer and must be performed by a competent operative.
  2. Any electrical equipment should be used with plugs and/or sockets as fitted.
  3. No equipment shall be modified without prior written consent from Canvas and Dreams.
  4. The customer shall be responsible at all times to arrange a proper supply of electricity for use with the equipment and ensure that the equipment shall at all times be properly earthed. Damage to equipment from incorrectly connected or disrupted supply will be charged.

Should the hot tub and related equipment become damaged during the hire period, the customer will be responsible for the repair costs. If the items are damaged beyond repair, the customer is responsible to cover the replacement cost of up to £700.

CINEMA HIRE

  1. It is the customer’s responsibility to check the projector and audio visual equipment at the time of collection or delivery.
  2. If there are any items missing or there is any visible damage to the projection equipment, the customer should inform Canvas and Dreams immediately, before they leave the customer’s premises. Canvas and Dreams will endeavour to replace missing items or damaged projection equipment.
  3. PLEASE BRING ALL PROJECTION EQUIPMENT INSIDE OVERNIGHT.

DISCLAIMER –  Do’s and Don’ts

  • DO respect the furniture and maintain the equipment.
  • DO bring all equipment inside and any potential additional equipment asked by Canvas and Dreams. If items are left outside after being asked to be brought inside, this will forfeit the deposit if items are damaged.
  • DO operate all electrical devices with caution.
  • DO make sure all of the electrical equipment/lights are switched off when leaving your outdoor cinema.
  • DO use our tables for food and drinks.
  • DO stay away from all wires, the projector and screen.
  • DO discuss projector connections (HDMI etc.) prior to use.
  • DO be mindful of the volume within the cinema hire.
  • DO keep all of our equipment clean.
  • DO NOT leave the outdoor heaters unattended under any circumstances.
  • DO NOT have any drinks near the electrical equipment.
  • DO NOT allow animals within the cinema hire or near the equipment.
  • DO NOT adjust the projector and stand once positioned correctly.
  • DO NOT move the patio heaters.

Should the projector and related equipment become damaged during the hire period, the customer will be responsible for the repair costs. If the items are damaged beyond repair, the customer is responsible to cover the replacement cost of up to £700.

 

GAZEBO HIRE

  1. The customer shall take all reasonable measures to keep the gazebos closed, dry and secure whilst not in use during the period of hire.
  2. The gazebos are not a permanent structure and can be damaged in very severe weather conditions. In the event of severe weather conditions including wind, frost, snow, hail, heavy rain and storms, the customer will take action to minimise damage to the equipment including ensuring that all equipment is secured.
  3. Please ensure that the space has been adequately measured.
  4. Please do not move the gazebo once it has been set up.
  5. Pets are not allowed within the gazebos.
  6. We operate a STRICT NO SMOKING policy inside the gazebos.
  7. Candles with flames are not permitted inside or near the gazebos. Battery operated candles or LED/solar lights are provided.
  8. For protection and safety, cooking is prohibited inside the gazebos. Fire pits and BBQ’s can cause fires and the release of deadly carbon monoxide.
  9. Canvas and Dreams cannot accept any responsibility or liability for losses or other costs incurred as a result of: acts of God including fire, flood, storm or natural disasters.
  10. The gazebo site must be on clear, flat firm ground with easy access, No drains, cables or other services should be buried beneath the surface or otherwise concealed. The hire charges do not include any making good or repairing of damage to the site.
  11. Please ensure the selected site is not susceptible to bogginess or has poor drainage. Any flooding caused is the responsibility of the customer.

Should the gazebo or any of its decor become damaged during the hire period, the customer will be responsible for the repair costs. If the gazebo is damaged beyond repair, the customer is responsible to cover the replacement cost of up to £600.

Booking, Deposit and Cancellations

  1. The booking becomes binding once Canvas and Dreams has received payment for equipment and confirmed the dates of the customer’s hire period.
  2. During the hire period a request can be made to extend the hire.  This is subject to availability and at Canvas and Dreams’ discretion.
  3. A non refundable deposit of £50.00 is required to secure the booking. The balance is due 7 days before the party.
  4. A security deposit of £50 will be taken at the time of booking, which will be refunded 72 hours after the hire period has ended. The customer is wholly responsible for ensuring that all the equipment is returned in the condition that it was delivered. If any equipment is returned damaged or severely soiled, Canvas and Dreams will either charge for repair or, if the equipment is deemed unrepairable, claim the entire replacement value. Canvas and Dreams do not allow the customer to obtain their own repair services.
  5. Loss to any Canvas and Dreams’ Equipment or furnishings will be charged for in full to the customer.
  6. In the event of extreme weather conditions, making it impossible to set up the gazebos/ hot tub/ cinema, Canvas and Dreams cannot accept any responsibility or liability for losses or other costs incurred as a result. In this situation, Canvas and Dreams will work with the customer to offer an alternative date.

COVID – 19 MEASURES

  1. Cross contamination between households will be eliminated by introducing a rest period of 3 days/72 hours between hire and additional cleaning before and after use.
  2. Equipment will be thoroughly cleaned or disinfected before it can be rehired. Everything that can be machine washed will be done so at 60 degrees to eliminate any possible cross-contamination.
  3. The customer must notify Canvas and Dreams before delivery if there are any members of the household who have tested positive for COVID-19 or are presenting with symptoms in the run up to or during hire. Canvas and Dreams will also notify the customer if at any point any members of our household become unwell with any symptoms of COVID-19 and reserve the right to cancel the hire if this situation arises. All deposits/payments can be moved to a new date if the customer/ Canvas and Dreams need to cancel because of this, or a full refund will be given.
  4. Canvas and Dreams will be adhering to strict hygiene measures in the hope to prevent any spread of COVID-19. However, it is impossible to guarantee that no cross-contamination of the virus will happen nor can Canvas and Dreams be held liable for any possible COVID-19 infection. ​
  5. All members of Canvas and Dreams have been double vaccinated with the booster also.
